The petitioner is languishing in custody in a case registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition & Excise Act.
There are recoveries of 7240 litres of spirit and 1356 litres of illicit indian made foreign liquor from a bolero pick-up van and five four-wheelers.
It is submitted by learned counsel for the
Patna High Court CR. MISC. No.80855 of 2023(3) dt.18-12-2023 2/3 petitioner that petitioner is innocent and he has falsely been implicated in this case. The petitioner was not apprehended from the spot. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has got no concern either with the seized vehicles or the illicit liquor and spirit. The petitioner is languishing in custody since 23.06.2023. Moreover, other similarly situated co-accused has been granted the privilege of bail by a coordinate Bench of this court vide order dated 21.10.2022 passed in Cr. Misc. No. 46915 of 2022.
In contra, learned A.P.P appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner.
Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise,
