JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 05-05-2023 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in a case registered for the offence punishable under sections 307/337/338/427 and other allied sections of the Indian Penal Code. As per the prosecution case, all the FIR named accused persons including 60 to 70 unknown persons threw bricks on the police party as a result of which five persons sustained injuries.
Learned counsel appearing for the petitioner submits that the petitioner has been identified in the video clippings, though there is general and omnibus allegation against him and no specific overt act has been alleged against the petitioner. Petitioner claims clean antecedent. Similarly situated coaccused has already been allowed pre-arrest bail by a coordinate bench of this Court vide

In the event of arrest/surrender within six weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate XIII, Bhagalpur in Bath Police Station Case No. 31 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
