JUSTICE ARUN KUMAR ORAL ORDER 04-04-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 4.12.2017, seeks bail in Aurai PS Case No. 49 of 2016 registered under Sections 304(B), 201, 120(B) and 34 of the IPC.

The allegation in brief is that on account of non fulfillment of dowry daughter-in-law of the petitioner was killed by the family members.

Learned Counsel for the petitioner submits that there is specific allegation against the husband of the deceased that one year prior to the occurrence demand was reiterated by him only but that allegation is not against the father-in-law and mother-in-law, moreover the mother-in-law was earlier granted anticipatory bail by a coordinate Bench of this Court in Cr. Misc. No. 12362 of 2018 and the husband is in custody.

Having considered the said facts and circumstances, the petitioner, namely, Puran Das is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub Judge 14th -cum ACJM 13th, Muzaffarpur in connection with Aurai PS Case No. 49 of 2016.
