1. Heard the parties.
2. The petitioner apprehends his arrest in connection with Khizerisarai P.S. Case No. 267 of 2023 dated 09.07.2023 registered under Sections 147, 148, 149, 341, 323, 325, 307, 427, 506 of the I.P.C.
3. As per the First Information Report on 09.07.2023 while the informant was engaged in construction of his house all the accused persons obstructed the informant and asked him to remove the shuttering. While the brothers of the informant objected, the co-accused / Jitendra Singh and Mantu Kumar assaulted the brothers of the informant by means

Learned counsel for the petitioner submits that no overt act has been alleged against the petitioner and he has falsely been implicated due to dispute regarding construction of parapet (chajja) by the informant. The petitioner is the neighbour of the informant and he has been made accused at the end of the F.I.R. with oblique motive. Similarly situated accused person Vikash Kumar has been granted anticipatory bail by a Co-ordinate Bench of this Court vide Cr. Misc. No. 73163 of 2023.

Regard being had to the submission made by the parties, taking into consideration the fact that no overt act has been alleged against the petitioner, similarly situated accused person has been granted anticipatory bail by this Court in Cr. Misc. No. 73163 of 2023 and both the parties are neighbours, as such, I am inclined to grant anticipatory bail to the petitioner.
6. Let the petitioner, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M.-IV, Gaya in connection with Khizerisarai P.S. Case
