2. Petitioners apprehend arrest in a case registered for the offence punishable under section 420 of the Indian Penal Code.

3. At the outset, learned counsel for the petitioners submits that the petitioners are ready to return Rs.5 lacs to opposite party no.2 in three equal instalments.

4. Considering the aforesaid undertaking, prayer for bail of all the petitioners is allowed. In the event of

No.2574 of 2023(5) dt.02-08-2023 2/2 arrest/surrender within six weeks from today, let these petitioners, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Judicial Magistrate 1st class, Gaya in Complaint Case No. 192 of 2018, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure as well as following conditions:- a) Receipt of payment of Rs.1.5 lacs to opposite party no.2 would be furnished by the petitioners at the time of furnishing bail bonds.

b) Rest of Rs.3.5 lacs would be returned to opposite party no.2 in three equal instalments in three months. c) In case of non compliance of these conditions, Court below would be at liberty to cancel the bail bonds. (Prabhat Kumar Singh, J) shashi/- U T
