2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 406, 420, 409, 467, 468, 471, 472, 120(B) of the Indian Penal Code and Sections 13(2), 13(1)(a) of the Prevention of Corruption Act.
3. It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in the present case. Petitioner has got no criminal antecedent mentioned in Para 3 of the bail application. As per F.I.R., the co-accused Awadhesh Singh had committed forgery and got the aforesaid amount transferred into his account. Similarly situated coaccused namely Lakshman Mahto has been granted anticipatory
Patna High Court CR. MISC. No.80045 of 2023(2) dt.15-12-2023 2/2 bail by a co-ordinate Bench of this Court vide order dated 11.08.2023 passed in Cr. Misc. No. 47821/2023.
4. Learned APP for the State has opposes the prayer for anticipatory bail.
5. Having regard to the facts and circumstances of the case and also similarly situated person is granted bail, let the above named petitioner, be released on bail, in the event of his arrest, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending/ successor Court in connection with Desari (Sahdai O.P.) P.S. Case No. 08 of 2016, corresponding to Special Case No. 33/2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
