JUSTICE SATYAVRAT VERMA ORAL ORDER 04-03-2023 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. The petitioner seeks bail in a case registered for the offences punishable under Sections 30, 30(A) of the Excise Act, 2018.

The learned counsel for the petitioner submits that the petitioner is in custody since 07.11.2022 and has antecedent of two cases and the allegation is of recovery of 110 litres of liquor from a motorcycle.

The learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case. It is next submitted that motorcycle does not belong to the petitioner. Learned A.P.P. opposes the bail application.

Considering the submission made by the learned

No.1131 of 2023(2) dt.04-03-2023 2/2 counsel for the petitioner, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Awatarnagar P. S. Case No.258 of 2022.

The application stands allowed.
