2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 325, 307, 379, 504, 506 of the Indian Penal Code.
3. As per prosecution case, all the F.I.R. named accused persons including this petitioner along with 12 unknown persons entered the coaching centre by breaking the door and on the order of this petitioner, all the accused persons brutally assaulted the informant and his brother.
4. It is submitted that as per F.I.R., petitioner is only alleged to be order giver. There is no allegation of assault against him. Petitioner claims clean antecedent.
5. Considering the facts and circumstances of the
Patna High Court CR. MISC. No.80180 of 2023(2) dt.10-01-2024 2/2 case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Jamui in connection with Chakai P. S. Case No. 39 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
