JUSTICE BIRENDRA KUMAR ORAL ORDER 23-03-2018 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offences punishable under Sections 120(B) of the Indian Penal Code and Section 25(1-b)a/26/35 of the Arms Act. A country made pistol and a cartridge was allegedly recovered from possession of the petitioner. Petitioner is in custody since 06.10.2017. Petitioner has stated on oath that he has got no criminal antecedent. Investigation is already complete now and the petitioner is ready to cooperate with the trial.

Considering the entire facts aforesaid, let the petitioner, above named, be released on bail after completion of nine months of custody on furnishing bail bond of

Patna High Court Cr.Misc. No.8709 of 2018 (3) dt.23-03-2018 Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Samastipur Muffasil Police Station Case No.606 of 2017, subject to the condition that the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
