2. The petitioner apprehends his arrest in connection with Tetarhat PS Case No. 10 of 2025 dated 20.01.2025, registered for the offences punishable under Sections 126(2), 115(2), 109(1), 329(1), 352 and 351(2) read with Section 3(5) of the B.N.S., 2023.
3. The allegation against the petitioner is of strangulating the daughter of the informant by wrapping gamcha over her neck, besides the other omnibus allegation of causing damage to the household articles of the informant and threatening.
4. Learned Advocate appearing on behalf of the petitioner submitted that in fact, the parties are own agnates and bickering over a land dispute since long and the criminal
Patna High Court CR. MISC. No.74344 of 2025(2) dt.25-11-2025 2/3 antecedents which have been mentioned in paragraph no. 3 of the bail petition are nothing but the offshoot of this enmity. Out of seven criminal cases, 6 of the criminal cases have been instituted by the family members of the informant. The injury which is sustained by the daughter of the informant is found to be simple in nature as is evident from the impugned order. Petitioner undertakes that he will abide with the terms and conditions of this Court and fully cooperate in the proceeding.
5. On the other hand, learned Advocate for the State vehemently opposed the pre-arrest bail application and submitted that the petitioner bears seven criminal antecedents and as such he appears to be a habitual offender.
6. Regard being had to the submissions advanced by the learned Advocates for the respective parties and taking note of the simple nature of injury coupled with the fact that the parties are agnates and there is pending land dispute between them, let the petitioner, above-named, be released on bail, in the event of his arrest or surrender before the Court below within a period of four weeks from the date of receipt / production of a copy of this order, upon furnishing bail bonds of Rs. 20,000/- (Twenty Thousand Only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate,

No.74344 of 2025(2) dt.25-11-2025 3/3 Lakhisarai, in connection with Tetarhat PS Case No. 10 of 2025, subject to the conditions laid down in Section 482(2) of the B.N.S.S., 2023, with the further condition that one of the bailors shall be the own / close family members of the petitioner.
