JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-10-2019 Petitioner seeks bail in anticipation of his arrest in connection with Bhagwanpur P.S. Case No. 150 of 2019, registered for the offences punishable under Sections 341, 323, 380, 494, 307, 498 (A)/34 the Indian Penal Code. Petitioner happens to be husband of the informant and it is said to have demanded one motorcycle and rupees four lacs and on fulfillment of demand lastly she ousted from the house. Earlier they attempted to kill her by administering poison and sprinkling kerosene oil.

Submission of the learned counsel for the petitioner is that there is no specific allegation has been attributed against

Patna High Court CR. MISC. No.68641 of 2019(2) dt.25-10-2019 2/2 the petitioner and allegation are general in nature. Moreover, petitioner is ready to keep her with dignity and care and the said submission has also taken before the learned lower Court but the same was not considered.

Having heard both sides, considering the above submission, this application allowed. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Five Thousand) with two sureties of the like amount to the satisfaction of learned A.C.J.M, V Kaimur at Bhabhua, in connection with Bhagawanpur P.S. Case No.-150 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the Court concerned with further condition that if informant appears before the Court and she is ready to reside with the petitioner he has to keep the informant with full dignity and care.
