JUSTICE BIRENDRA KUMAR ORAL ORDER 27-03-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is languishing in custody for the offences punishable under Sections 413/414/420 of the Indian Penal Code.

The petitioner is in custody since 14.10.2017. Allegation is that a stolen motorcycle was recovered from the house of the petitioner.

Submission is that the investigation is already complete and some other co-accused having similar allegation have already been allowed bail by a coordinate Bench of this Court. Another co-accused Afsar Ali has already been allowed bail by this Court in Cr. Misc. No.12670 of 2018.

Patna High Court Cr.Misc. No.9278 of 2018 (3) dt.27-03-2018 P2/ Considering the aforesaid fact, let the petitioner, above named, be released on bail on completion of six months of custody on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Daraunda (M.H. Nagar) P.S. Case No.184 of 2017, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
