Mr.Brajendra Nath Pandey ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 24-03-2023 Heard Mr. Krishna Prasad Singh learned senior counsel for the petitioners and the State.

The petitioners apprehend their arrest in a case registered for the offences punishable under Section 307 and other allied sections of the Indian Penal Code and section 27 of the Arms Act.

As per the prosecution case, on the alleged date and time of occurrence, while the informant and his friends were returning home, on the way, all the accused persons including petitioners assaulted them with danda, iron rod etc. Co-accused

Patna High Court CR. MISC. No.14 of 2023(2) dt.24-03-2023 2/2 Prakash Singh assaulted the informant with butt of pistol and he also opened fire which did not hit anyone. All the accused persons also snatched gold chain of informant worth Rs. 25,000/-.

It is submitted that specific accusation of firing is against co-accused Prakash Singh. Though, there is allegation against all the accused persons that they assaulted the informant, but only one injury was found on the person of informant. Petitioners claim clean antecedent.

Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Daudnagar, Aurangabad in connection with Goh P.S.
