This is an application for regular bail in connection with S.T. No. 158 of 2017 arising out of Jhajha P. S. Case No. 228 of 2016 registered for the offences punishable under Sections 25(1b)a, 26 and 35 of the Arms Act and under sections 16, 17, 18, 19, 20, 21 and 22 of the UAP Act.
Informant is the Officer-in-Charge of Jhajha police station who has stated in his written complaint that on 16.10. 2016 at about 9 P.M. he received an information from the Superintendent of Police, Jamui, that Sub Zonal Area Commander Peru Yadav along with his associates has come for extorting levy and he should take steps to arrest him along with other police force. On receiving such information , informant along with other police force surrounded the forests
Patna High Court Cr.Misc. No.7128 of 2018(3) dt.05-03-2018 2/2 and carried out search operation. In the morning at 5 O'clock one person was found fleeing away and he was apprehended and he disclosed his name as Peru Yadav and from his possession one rifle and one cartridge were recovered and on his identification four other arms and five cartridges were recovered from the bush in the jungle.
It has been submitted that charges have already been framed against this petitioner. No prosecution witness has been examined in the trial court and for which necessary summons have been issued. But still no witness has turned up before the court. It has been submitted that petitioner is in custody since 16.10.2016.
Considering the facts and circumstances of the case, let above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned 2nd Addl. Sessions Judge, Jamui, in connection with S.T. No. 158 of 2017 arising out of Jhajha P. S. Case no. 228 of 2016. (S. Kumar, J) sudip/- U T
