2. In this case, the petitioner is seeking regular bail in connection with Saharsa Sadar P.S. Case No. 829 of 2023, registered for the offences punishable under Sections 392 of the Indian Penal Code and Section 27 of the Arms Act.

3. The learned counsel for the petitioner submits that the bail petition of the petitioner was rejected vide order dated 03.07.2024 in Cr. Misc. No. 21819 of 2024 by this Court. He further submits that the petitioner is a persons of clean antecedent but in the order dated 03.07.2024 in paragraph no.5 it has been mentioned that he is involved in two cases as reflected by paragraph no. 132 of the case diary.

4. As a matter of fact, the criminal history of Gaurav Kumar has been mentioned in paragraph 132 of the case diary and in the same paragraph, it has been mentioned that the petitioner is a person of clean antecedent.

5. Learned counsel for the petitioner further submits that the petitioner is under custody since 10.12.2023.

6. Considering the fact that the petitioner is a person of clean antecedent, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Saharsa Sadar P.S. Case No. 829 of 2023, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
