Petitioner, already in custody, seeks bail in connection with Chakia P.S. Case No.249 of 2017, registered under Sections 461 and 379 of the Indian Penal Code.

Submission is that petitioner is not named in the FIR, no incriminating article was recovered from his possession, the only material is the disclosure of his name in the confessional statement of a co-accused and the petitioner has no criminal antecedent.

Having considered the said facts and circumstances, petitioner Ram Pukar Sahani is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned

Patna High Court Cr.Misc. No.11604 of 2018(2) dt.27-02-2018 2/2 CJM, Motihari in connection with Chakia P.S. Case No.249 of 2017, subject to verification of the criminal antecedent of the petitioner. If any criminal antecedent is found against the petitioner, he shall not be released.
