Petitioner, already in custody, seeks bail in connection with Bakhtiarpur P.S. Case No.327 of 2016 registered under Sections 302/34 of the Indian Penal Code.

Specific allegation against the petitioner is that he stabbed two times in the stomach of the deceased causing his death.

Learned counsel for the petitioner submits that other two co-accused persons have been admitted to bail by this Court; whereas the learned counsel for the informant and the State submit that no overt act of assaulting the deceased is alleged against the persons who have been admitted to bail by this Court.
