JUSTICE ARUN KUMAR ORAL ORDER 15-03-2018 Heard learned Counsel for the petitioner and the learned Counsel for the State as also the learned Counsel appearing on behalf of the informant.

Petitioner, already in custody, seeks bail in Rail Bhagalpur PS Case No. 84 of 2017 (S.T. No. 834 of 2017), registered under Sections 324, 307, 120(B), 302 of the IPC and Section 27 of the Arms Act.

The allegation in brief is that while the informant was going along with Pramod Sah in the train, he was shot from back and later on succumbed to the injuries.

Submission is that the petitioner is not named in the FIR, deceased had dispute with his daughter-in-law Rinki Devi and there is no material against him except confessional statement made by Rinki Devi against the petitioner that she had given money to the petitioner for eliminating her father-in-law, however the petitioner has no criminal antecedent and is in custody since 14.5.2017. Having considered the said facts and circumstances, the petitioner Pancham Mandal is directed to be released on bail on
