The petitioner seeks bail in connection with Khagaria (Muffasil) P.S. Case No.692 of 2022 registered for the offence under Sections 406, 409 and 420 of the Indian Penal Code.

Allegation against the petitioner is to have taken bribe of Rs. 15,000/- to Rs.30,000/-.

Learned counsel appearing on behalf of the petitioner has submitted that petitioner has falsely been implicated in the present case. It is submitted that nothing incriminating materials have been surfaced, during course of investigation, which may connect the petitioner, with the present

Patna High Court CR. MISC. No.79750 of 2023(3) dt.18-03-2024 2/2 set of occurrence. It is also submitted that other co-accused persons, namely, Guddu Paswan @ Jitendra Kumar Priyadarshi, Ex-Mukhiya and Mantu Paswan have already been granted anticipatory bail by learned District and Sessions Judge, Khagaria in ABA No.983 of 2022 on 04.11.2022 and ABA No.620 of 2023 on 31.05.2023 respectively. It is further submitted that petitioner is a man of clean antecedent, where, petitioner has voluntary surrendered and is in custody since 05.09.2023.

Learned APP appearing for the State, opposes the prayer for bail of the petitioner. 6.

Considering the facts and circumstances and submissions made on behalf of the petitioner, let the petitioner, above named, is directed to be released on bail in connection with Khagaria (Muffasil) P.S. Case No.692 of 2022 on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria.
