ANJANA MISHRA ORAL ORDER 24-01-2020 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are apprehending their arrest in connection with Kumarkhand P.S. Case No.159 of 2018 registered for the offence punishable under Sections 147, 148, 149, 341, 323, 324, 337, 427, 354(B), 379, 307, 504, 506/34 of the Indian Penal Code.
Learned counsel for the petitioners submits that in all
Patna High Court CR. MISC. No.73954 of 2019(2) dt.24-01-2020 2/2 there was allegation against 22 named persons, including the petitioners. It is, however, submitted that so far as the present petitioners are concerned, there is no specific allegation of overt act having been committed by them and the main allegation is against one Md. Salim and not against these petitioners. Considering the aforementioned facts and circumstances and that the petitioners are having no criminal antecedents, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Madhepura, in connection with Kumarkhand P.S. Case No.159 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
