The petitioner is in custody since 11.09.2019 in connection with Phulwari PR No. 181 of 2019 arising out of Special Case No. 8192/19 for the offence registered under Sections 30(a), 32 (1) (3), 41 (1) (2) of the Bihar Excise and Prohibition Amendment Act.

Learned counsel for the petitioner submits that there is no recovery from the conscious possession of the petitioner but from the Bolero Vehicle with which the petitioner has nothing to do.

Considering the aforesaid facts and circumstances of the case and that the petitioner has no criminal antecedent, let
