2. Learned counsel for the petitioner submits that the case of the petitioner is squarely covered by the judgment passed by a Co-ordinate Bench of this Court in Neelam Kumari & Ors. v. The State of Bihar & Ors in CWJC No. 11843 of 2014 dated 14.09.2018.

Having heard learned counsel for the parties and taking into consideration the submissions, the writ petition is disposed with liberty to the petitioner to approach the Respondent No.5/The Principal Secretary, General Administrative Department, Government of Bihar, Patna by filing a representation within a period of two weeks, the respondent no. 5 shall dispose of the same after affording opportunity of personal hearing or through his counsel by passing a reasoned and a speaking order, in accordance with law, within a period of eight weeks, thereafter.

4. If it is found that the case of the petitioner is covered by the Neelam Kumari & Ors., then similar benefits shall be granted to the petitioner.

5. Respondent no. 5 shall be solely liable for noncompliance of this order within the stipulated period.

6. The writ petition stands disposed of on the aforesaid terms.
