JUSTICE BIRENDRA KUMAR ORAL ORDER 19-04-2018 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners are in custody in connection with K Hat P.S. Case No.686 of 2017, a case under Section 379 of the Indian Penal Code against unknown.

The petitioners were apprehended by the police on 24.09.2017 and from their possession stolen motorcycle as well as fire-arm were recovered. The recovered motorcycle was of this case.

For recovery of fire-arms K. Hat P.S. Case No.682 of 2017 was registered wherein the petitioners have already been allowed bail by a coordinate Bench of this Court in Cr. Misc. No.6510 of 2018. The petitioners are in custody since 15.11.2017

Patna High Court Cr.Misc. No.21909 of 2018 (2) dt.19-04-2018 P2/ for recovery of stolen motorcycle.

Considering the aforesaid fact, let the petitioners, above named, be released on bail after completion of six months of custody on furnishing bail bond of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with K. Hat Police Station Case No.686 of 2017, with condition that the petitioners shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
