2. The petitioner has prayed for regular bail in connection with Sitamarhi Cyber P.S. Case No. 43 of 2024, for the offence punishable under sections 406, 420, 385, 506, 120B, 504 of the Indian Penal Code.

3. The case of the prosecution is that the son of the informant namely Dilip Kumar Yadav who is Ex- MLC was mentally ill and due to this illness lakhs of rupees has been fraudulently taken away from his different account of the Dilip Kumar Yadav is given under F.I.R. During course of investigation, one Tripurari Singh was apprehended. Tripurari Singh has named this petitioner.

4. Learned counsel for the petitioner submitted that

Patna High Court CR. MISC. No.78654 of 2024(4) dt.27-01-2025 2/2 Tripurari Singh and this petitioner filed bail petition before the trial court. Both were directed to renew their prayer for bail after framing of charge. After framing of charge, Tripurari Singh has renewed his prayer for bail and has been granted bail but as the bail petition of this petitioner was pending before this Court, this petitioner has come before this Court. From the order of trial court it is clear that the petitioner was granted liberty to renew his prayer for bail after framing of charge. Charges has already been framed.

5. Learned APP appearing for the state vehemently opposed the prayer for bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Sitamarhi Cyber P.S. Case No. 43 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi.
