The petitioner seeks bail in Koilwar P.S. Case No. 128 of 2016 registered under Section 386, 504 and 506 of the Indian Penal Code.

Some unknown miscreants are said to have exploded bomb on the gate of the cold storage and in N.S. Mall at Ara over demand of extortion from the traders.

It is submitted by learned counsel for the petitioner that the petitioner is neither named in the F.I.R. nor was apprehended on the spot. There is nothing on record indicating the complicity of the petitioner in the occurrence barring his confessional statement and the confessional statement of Krishna

Patna High Court Cr.Misc. No.6745 of 2018 (03) dt.20-02-2018 - 2 - Kumar Singh which has no evidentiary value in the eye of law. Petitioner has no concern with the aforesaid occurrence. Though one more case under the Immoral Traffic Act has been lodged against the petitioner but he is on bail in the said case. The petitioner has been languishing in custody since 03.05.2016. In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Koilwar P.S. Case No.128 of 2016.
