Petitioner apprehends arrest in a case registered for the offence punishable under sections 363, 366-A, 379/34 of the Indian Penal Code.

As per the prosecution case, this petitioner and three other co-accused persons kidnapped minor daughter of the informant and took away golden ornaments and cash of Rs.51,000 from the house of the informant and fled away. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case only on the basis of suspicion. The victim in her statement under section 164 Cr.P.C has not supported the prosecution case and she has not stated anything wrong against the petitioner.

Considering the statement of the victim under section 164 Cr.P.C and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnea in connection with Baisi P.S. case no 211 of 2022. subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
