JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-12-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under section 414 of the Indian Penal Code. The stolen vehicle is said to have been recovered from front of the house of one Brij Bihari Yadav but the key of the aforesaid vehicle was handed over to the police by mother of the petitioner and she also disclosed that petitioner had purchased the seized vehicle.

Submission on behalf of the petitioner is that even if, it assumed that petitioner had purchased the said vehicle, then also, petitioner appears to be bona fide purchaser. Moreover, petitioner does not have any criminal antecedent and is

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Buxar in connection with Buxar (Muffasil) P.S.
