Petitioner apprehends arrest in connection with Dalsinghsarai P.S. Case No. 367 of 2023 registered for the offence punishable under sections 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case. Nothing has been recovered from the conscious possession of this petitioner. Petitioner is neither the owner nor the driver of the alleged truck and Alto car. Petitioner has no concern with the seized article.

Considering the facts and circumstances of the case

Patna High Court CR. MISC. No.77189 of 2023(2) dt.29-11-2023 2/2 and the submissions advanced on behalf of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise I, Samastipur in connection with Dalsinghsarai P.S. Case No. 367 of 2023 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
