JUSTICE MADHURESH PRASAD ORAL ORDER 05-04-2018 Heard counsel for the petitioner and the State. Petitioner is an accused in a case registered for offence under sections 419, 420, 468 and 471 IPC.

It is submitted on behalf of the petitioner that the petitioner is a rustic lady and her bona fide conduct is apparent from the fact that on being pressurized by the informant to return the amount allegedly received in her account she has lodged an informatory petition which is Annexure 2. Petitioner is in custody since 8.1.2018 and has no criminal antecedent. It is submitted that since regular amount was being repatriated in the petitioner's account from her husband who lives abroad, the petitioner could not realize that her account was being misused by some persons for transferring the fund for the same. At best as per the order of the learned Sessions judge, the amount of Rs. 76000/- has been transferred to the account of the petitioner.

Patna High Court Cr.Misc. No.11491 of 2018 (3) dt.05-04-2018 Considering the aforesaid submissions, prayer for bail of the petitioner is allowed. Let the petitioner, mentioned above, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Sri R.M.Tiwari, Judicial Magistrate 1st class, Saran at Chapra in Daudpur Police Station Case No. 236 of 2017 on the following conditions:- One of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

The Petitioner will be well represented on each date and if she fails to do so on two consecutive dates, her bail will be liable to be cancelled.
