2. Petitioner seeks regular bail in connection with Mairwa P. S. Case No. 287 of 2025 in a case registered for the offences punishable under Sections 103(1), 238 and 61 read with Section 3(5) of the Bharatiya Nyaya Sanhita.
3. As per the prosecution case, the informant alleged that on 02.07.2025 her daughter Khushi Kumari had gone to school, but she did not return to her house, accordingly, the present F.I.R. was lodged against unknown.
4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. It is further submitted that the petitioner is not named in the FIR and her named has transpired in this case
Patna High Court CR. MISC. No.74736 of 2025(2) dt.13-11-2025 2/2 merely on the basis of confessional statement of the co-accused Akash Singh and except confessional statement of co-accused person there is no material on record to show the complicity of the petitioner in the said occurrence. Petitioner has clean criminal antecedent and she is in custody since 08.07.2025. Charge-sheet has already been submitted.
5. However, learned A.P.P. for the State vehemently opposed the bail application.
6. Considering the nature of accusation and period of custody, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-V Siwan/concerned Court below in connection with Mairwa P. S. Case No. 287 of 2025.
