JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 15-05-2023 Heard learned counsel for the petitioner, learned counsel for the informant and learned APP for the State. The instant application for regular bail has been filed by the petitioner registered for the offence punishable under Sections 366(A), 365/34 of the Indian Penal Code. Prosecution case relates to abduction of minor daughter, aged 15 years, of the informant by the petitioner in connivance with his other family members.

Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. There was love affair between the petitioner and daughter of the informant. Victim was in talking term with the petitioner for the last 3-4 years. Statement of the victim girl was recorded u/s 164 Cr.P.C. in which she has stated that she was in

No.940 of 2023(3) dt.15-05-2023 2/2 love with the petitioner and out of her own sweet will, she has eloped with him and live with him for ten days in a hotel near Patna station. She has not raised any finger against the petitioner for any physical misbehave. As per medical report, doctor has assessed her age as above 18 years. Petitioner is languishing in judicial custody since 2.10.2022.

Learned APP appearing for the State and learned counsel for the informant have opposed the prayer of Bail and submitted there is direct allegation of abduction of minor girl against the petitioner.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned CJM, Bhojpur at Ara in connection with Udwantnagar P.S. Case No. 452 of 2022.
