JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-11-2019 Petitioner seeks bail in anticipation of his arrest in connection with Salimpur P.S. Case No. 96 of 2016 registered for the offence punishable under Section 392 of the Indian Penal Code.
As per FIR while informant was coming on motorcycle with cash of Rs.52,477/-, some miscreants came on two motorcycles and snatched the bag containing the said amount from the informant and fled away and informant claims to have identified the accused persons. It appears that petitioner is not named in the FIR but later on on the basis of statement of one witness his name transpired.
Submission of learned counsel for the petitioner is that he has falsely been implicated only on the statement of one witness, who is not even an eye-witness to the occurrence.
Patna High Court CR. MISC. No.69547 of 2019(2) dt.06-11-2019 2/2 Heard learned APP, who has opposed the prayer for anticipatory bail stating that informant claims to have identified the accused persons, as such custodial interrogation is required in this case and apart from that he is accused in five other cases, some of them are of similar type.
In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner.
Hence, this application is dismissed.
