====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 04-12-2024 Heard Mr. Dwij Raj, learned counsel appearing on behalf of the petitioner and Mr. Mritunjay Kumar Nirala, learned APP for the State.

2. The petitioner seeks pre-arrest bail in connection with Bairganiya P.S. Case No. 201 of 2024 registered for the offence punishable under Sections 281, 125(a) of the Bharatiya Nyaya Sanhita, 2023 and 30(a)(c) of the Bihar Prohibition and Excise Act as amended up-to-date.

3. Considering the nature of allegation made in the FIR, as well as, total amount of recovery of illicit liquor, I am not inclined to enlarge the petitioner on pre-arrest bail.

4. However, the petitioner, if so advised, may surrender before the learned District Court and seek regular bail.

Patna High Court CR. MISC. No.79885 of 2024(2) dt.04-12-2024 2/2 The learned District Court is directed to consider the regular bail application of the petitioner on the same day and pass a reasoned order in accordance with law.
