2. The petitioners are apprehending their arrest in connection with Didarganj P.S. Case No. 213 of 2025 for the offence under sections 126(2), 115(2), 324(4), 121(1), 121(2), 132 and 352 of the B.N.S. lodged on 16.06.2025 by the informant, Krishna Rai.

3. As per the prosecution story, the informant alleged that the Police went with armed forces to arrest the accused in connection with Didarganj P.S. Case No. 147/2025 but they were greeted with stones and bricks which caused damages to the vehicles. Anyhow, the Police was able to arrest Sohan Singh while rest managed to escape. Later, Sohan Singh also fled away from the Police Station. This led to the FIR.

Learned counsel for the petitioners submit that despite they being on bail, the Police wanted to arrest them which resulted into the scuffle and if granted relief, they shall be diligently appearing in trial. The further submission is that without accepting the allegation and/or the outcome of the present case, they intend to contribute Rs. 3,000/- each (totalling Rs. 21,000/-) for the purchase of flower pots/beautification of the campus issued in the name of Station Head Officer, Didarganj Police Station, Patna through Demand Draft issued by the local branch of the State Bank of India/any Nationalized Bank.
5. Learned APP, Mr. Jitendra Kumar Singh opposes the prayer submitting that a perusal of the FIR would show that all these petitioners who are accused in the present case are also part of Didarganj P.S. Case No. 147 of 2025 and Police could
3/4 arrest only Sohan Singh while the others managed to escape after damaging the Government vehicle.

Allegation is there, the contention of the petitioners are that they were already on bail and wanted to show the same to the Police, scuffle took place which has been exaggerated and have undertaken to diligently appear in trial, in that background, this Court is inclined to extend them the privilege of anticipatory bail with conditions subject to payment of Rs. 3,000/- each (totalling Rs. 21,000/-) for the purchase of flower pots/beautification of the campus issued in the name of Station Head Officer, Didarganj Police Station, Patna through Demand Draft issued by the local branch of the State Bank of India/any Nationalized Bank.
7. Let the petitioners be released on bail in the event of arrest or surrender within a period of four weeks from the receipt of this order, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of like amount each to the satisfaction of learned Court of J.M.F.C., Patna City in connection with Didarganj P.S. Case No. 213 of 2025 subject to the following conditions:
(i) one of the bailor should be the family member/relative of the petitioners who shall provide official
4/4 document to show his/her bona fide;
(ii) the petitioners shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of their bail bond by the Trial Court itself;
(iii) the petitioners shall appear before the concerned police station every fortnight for six months to mark his attendance and after the end of the period, the certificate shall be submitted before the Trial Court failing which steps shall be taken for the cancellation of the bail bonds; (iv) the petitioners shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;
(v) the petitioners shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of their bail bonds. (Rajiv Roy, J) Adnan/- U T
