Petitioners apprehend their arrest in a case registered for the offence punishable under Sections 307, 504/448 of the Indian Penal Code.
Prosecution's case in short is that all the FIR named accused persons including these petitioners assaulted the informant and others as a result of which three persons including the informant sustained injuries.
Patna High Court CR. MISC. No.5208 of 2023(2) dt.13-04-2023 2/2 Learned counsel appearing for the petitioners submits that due to drainage/gali dispute, occurrence of simple marpit took place between the parties. Case and counter case. Injury caused by the petitioners have been found to be simple in nature by doctor. Petitioners have got no criminal antecedent. Considering the nature of allegation against the petitioners, in the event of arrest/surrender within six weeks from today, let the petitioners, named above, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad in Barun Police Station Case No. 441 of 2022, subject to the conditions laid down under sections 438(2) of the Code of Criminal Procedure.
