Frequent indulgence in transportation, storage, sale of wine regarding which police got confidential information, firstly the house of Nitish Kumar was seasrched wherefrom 500.4 litres foreign liquor (Indian origin) were seized. Nitish alongwith his uncle and grand-father Nazir Rai, Jagdish Rai were arrested. On their disclosure house of Manohar Rai, Bilat Rai and Saina Rai (petitioner no.1) were searched and so far Saina Rai is concerned, from his house altogether 279 litres foreign liquor of Indian origin were seized. He had further confessed that he alongwith his brother-in-law Anup Kumar
Patna High Court CR. MISC. No.69166 of 2019(3) dt.17-03-2020 2/2 (petitioner no.2) were actively involved therein. Further more, on his disclosure the houses of Jaipal Rai @ Ramjaipal Rai, Shrawan Kumar, Anjit Rai were also raided and therefrom also wines were recovered. After preparing respective seizure list all have been apprehended. The petitioners are under custody since 26.7.2019 having no criminal antecedent as per paragraph-3 of the petition.
Consequent thereupon, the petitioners, namely, Saina Rai and Anup Kumar are directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Special Judge, Excise, Patna in connection with Special Case No. 6680/2019 arising out of Barh P.S.Case No. 346/2019.
