JUSTICE BIRENDRA KUMAR ORAL ORDER 28-03-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is languishing in custody for the offence punishable under Section 395 of the Indian Penal Code. The petitioner is in custody since 06.02.2107. The FIR of dacoity of tractor is against unknown. Submission is that the petitioner was never put on Test Identification Parade nor anything was recovered from the possession of the petitioner. Investigation of the case is already complete and petitioner is ready to cooperate with the trial. Considering the aforesaid submission, let the petitioner, above named, be released on bail on furnishing bail

Patna High Court Cr.Misc. No.16919 of 2018 (2) dt.28-03-2018 P2/ bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Chanpatiya P.S. Case No.229 of 2016, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
