2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 379, 411, 420, 467, 468, 471, 120(B), 34 of the Indian Penal Code.
3. As per F.I.R., Police has seized three trucks with sand loaded and also seized one Scorpio along with the driver.
4. It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in the present case. Petitioner has got no criminal antecedent mentioned in Para 3 of the bail application. He further submits that in the body of the F.I.R. he has been mentioned owner of the seized Scorpio and in Column 7 petitioner has not made accused but in
Patna High Court CR. MISC. No.80570 of 2023(2) dt.18-12-2023 2/2 application he has shown as owner of the Scorpio.
5. Learned APP for the State has opposes the prayer for bail.
6. Having regard to the facts and circumstances of the case and also considering the fact that petitioner is made accused on the basis that he is owner of the Scorpio, let the above named petitioner, be released on bail, in the event of his arrest, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending/ successor Court in connection with Rajgir P.S. Case No. 537 of 2022, subject to the condition as laid down under Section 438
(2) of the Cr.P.C.
