2. The petitioner is apprehending his arrest in connection with Excise Thana Hajipur P.S. Case No. 46 of 2024 for the offence registered under Sections 30(a), 32(2), 41(1), (2) of the Bihar Prohibition and Excise (Amendment) Act, 2018 on 19.02.2024 by the informant Suresh Prasad Choudhary.

3. As per the prosecution story, the informant alleged that upon secret information it reached Dharmpur Chowk and intercepted a white coloured ALTO Car and there is recovery of 200 litre of illicit country made liquor. This led to the FIR.

4. Learned counsel for the petitioner submits that the petitioner is not the owner of the Car and only because the police got secret information that he is doing the illegal work of

Learned App on the other hand submits that on specific information about the presence of this petitioner alongwith liquor which was to be loaded in the ALTO Car, the police went there and found the information to be correct, recovery also took place. Further, he has criminal antecedent of the same nature.

6. Considering the aforesaid facts/submissions as also his criminal antecedent, it would be appropriate that he seek bail.

7. His prayer for anticipatory bail stands rejected.

8. If the petitioner surrender within four weeks from today, the court concerned shall take up the matter and if possible, dispose it of on the same day.
