The petitioner, who is in custody, seeks bail in connection with Hulasganj P.S. Case No. 103 of 2017 registered for the offence punishable under Sections 302, 120(B) of the Indian Penal Code.
Informant is the son of deceased who, in his written complaint has stated that his father was doing job as a Private Night Guard and on 02.09.2017 at 5:00 PM he left his house for his duty and did not return on 03.09.2017 and thereafter informant and other family members started searching him but he was told that he did not report at duty on

No.5329 of 2018(4) dt.27-02-2018 2/3 the previous night and thereafter he received information that a dead body was lying in the orchard and when he went there alongwith all family members he found his father to be murdered. It has been further alleged that some time before there was altercation between the family of the Ramdeep Yadav and informant on a trivial issue and they have threatened that his family will be killed and thereafter an arbitration was held and on 2.09.2017 when he was returning on motorcycle with his uncle he saw accused Lalu Yadav going on motorcycle and his father was sitting behind his motorcycle. Learned counsel for the petitioner submitted that he is innocent and has been falsely implicated in this case on the basis of suspicion only.
It has further been submitted that he has been made accused in the FIR on the basis of suspicion only and there is no eye witness of the occurrence. It has further been submitted that petitioner has no criminal antecedent and he is in custody since 31.10.2017. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs.
