In this case, the petitioner is seeking regular bail in connection with Obra P.S. Case No. 300 of 2020, registered for the offences punishable under Sections 302/328/34 of the Indian Penal Code.

The informant is brother of the deceased. As per allegation, the marriage of his sister Jarima Khatoon was solemnized with late Mr. Manauwar in the year 1995. After seven years of marriage Manauwar died and the sister of the informant was residing in her matrimonial house on 19.10.2020. He got an information that she committed suicide by consuming poisonous substance. The informant rushed there and saw her

The informant has stated further that since his sister was a widow lady. The petitioner and her husband Md. Nehal Alam were usually made altercation with her. The informant expressed his firm belief that Md. Nehal and the petitioner killed his sister by administering poisonous substance.

The learned counsel for the petitioner has submitted that she is innocent and has falsely been implicated. As a matter of fact, the deceased consumed poisonous substance herself and the informant has falsely implicated the petitioner and her husband Md. Nehal Alam. Learned counsel has also submitted that Md. Nehal Alam has been granted bail by the coordinate Bench of this court in Criminal Miscellaneous No. 35628 of 2020.

Considering the above-mentioned facts and circumstances and also considering that the husband of the petitioner had already been granted bail by a coordinate Bench of this Court, let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned SDJM, Daudnagar, Aurangabad in connection with Obra P.S. Case No. 300 of 2020, subject to the following conditions:-

(ii) If the petitioner is found involved in future in the similar type of offense, the prosecution will have liberty to file an application before the court below for cancellation of the bail of the petitioner and the learned court below will take decision in accordance with law.
