2. The petitioners apprehend their arrest in connection with Mehandiya PS Case No. 251 of 2024 dated 26.12.2024, registered for the offences punishable under Sections 126(2), 115(2), 117(2), 118(1), 109, 74 and 352 read with Section 3(5) of the B.N.S., 2023.
3. The allegation against petitioner no. 2 is of catching hold of the mother of the informant, whereupon the petitioner no. 1 assaulted her by means of a small wooden log. There is further allegation on other accused persons of causing assault upon the informant and others.
4. Learned Advocate appearing on behalf of the
Patna High Court CR. MISC. No.74366 of 2025(2) dt.25-11-2025 2/3 petitioners submitted that petitioners are women having absolutely fair antecedent. Only, on account of previous land dispute, their names have been implicated in this case with a view to put pressure and wreak vengeance. Even if the allegation is taken to be true for the sake of argument on account of the assault having made by the petitioners, none has sustained any injury.
5. On the other hand, learned Advocate for the State vehemently opposed the pre-arrest bail application and submitted that petitioners have actively participated in the crime.
6. Regard being had to the submissions advanced by the learned Advocates for the respective parties and considering the accusations against the petitioners besides the fact that petitioners are women having fair antecedent and there is no corresponding injury on account of the assault having been made by the petitioners, let the petitioners, above-named, be released on bail, in the event of their arrest or surrender before the Court below within a period of four weeks from the date of receipt / production of a copy of this order, upon furnishing bail bonds of Rs. 5,000/- (Five Thousand Only) each with two sureties of the like amount each to the satisfaction of the learned
Patna High Court CR. MISC. No.74366 of 2025(2) dt.25-11-2025 3/3 Chief Judicial Magistrate, Arwal, in connection with Mehandiya PS Case No. 251 of 2024, subject to the conditions laid down in Section 482(2) of the B.N.S.S., 2023, with the further condition that one of the bailors shall be the own / close family members of the petitioners.
