JUSTICE CHANDRA SHEKHAR JHA ORAL ORDER 10-11-2025 Heard learned counsel appearing on behalf of the petitioner and learned A.P.P. for the State duly assisted by learned counsel for the informant.

2. The accused/petitioner seeks bail in connection with Budha Colony P.S. Case No. 242 of 2025 registered for the offences under Sections 64, 351(2), 352 of the Bhartiya Nyay Sanhita, 2023 (in short, the 'B.N.S.') and section 66(C) of the I.T. Act, 2000.

3. The accused/petitioner is named in the First Information Report and is in custody since 06.07.2025.

4. Allegation against the petitioner is to commit rape upon the informant aged about 20 years and make the obscene video clip of their relationship viral to different social media platform.

It is submitted by learned counsel appearing on behalf of the petitioner that admittedly as per statement of the victim recorded under section 183 of the B.N.S.S., the informant was in live-in-relationship with the petitioner since last two years before lodging this FIR. It is submitted that after breakup of their relationship, the present false implication was raised against the petitioner. It is submitted that before lodging this case, one case being Budha Colony P.S. Case No. 131/2025 was registered by the informant against the petitioner, where only allegation of outraging modesty was raised, but as the petitioner was released on bail by the learned trial court itself, the present false case was lodged with only oblique motive to keep this petitioner behind the bar for no reason.

6. While concluding argument, it is submitted that petitioner found involved in on more criminal case, where he is on bail and, moreover, investigation of this case is already completed, for which chargesheet has been submitted and as such, there is no chance of tampering with the evidence.

7. Learned A.P.P. for the State duly assisted by learned counsel for the informant, while opposing the

No.75420 of 2025(2) dt.10-11-2025 3/3 prayer of bail of the petitioner, submitted that petitioner was regularly threatening the informant over phone, which was seized from him, where he could not disputed the factual submission as advanced by learned counsel for the petitioner.

In view of aforesaid factual submission and by taking note of the fact as admittedly the informant was in live-in-relationship with the petitioner for long two years before lodging this FIR, coupled with the fact that petitioner remains in custody since 06.07.2025, where investigation of this case is already completed, accordingly, above-named petitioner is directed to be released on bail, furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - XIV, Patna/concerned court, in connection with Budha Colony P.S. Case No. 242 of 2025, subject to the condition as laid down under Section 437(3) Cr.P.C/Section 480(3) of the Bhartiya Nagarik Suraksha Sanhita (in short "B.N.S.S.").
