This is an application for regular bail in connection with Harsidhi P. S. Case No. 444 of 2017 registered for the offences punishable under Sections 304B, 201 and 34 of the Indian Penal Code.

Petitioner is the brother-in-law of the deceased. Informant is brother of deceased, who has stated in the FIR that marriage of the deceased was solemnized with Umesh Sah and thereafter there was demand of motorcycle and she-buffalo and due to non-fulfilment of which she was tortured. On 4.11.2017 two unknown villagers informed that his sister has been killed and her body has been concealed.

It has been submitted by learned counsel for petitioner that he has falsely been implicated in this case and there is

Patna High Court Cr.Misc. No.14061 of 2018(3) dt.05-04-2018 2/2 separation of husband of the deceased and petitioner since long and they are residing separately. Petitioner has no concern with the family affairs of the deceased or his husband. It is further submitted that petitioner is in custody since 23.11.2017 and has no criminal antecedent.

Considering the facts and circumstances of the case, let above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran, in connection with Harsidhi P.S. Case no. 444 of 2017.
