The petitioners apprehend their arrest in connection with Sheikhpura (Mahila) P.S. Case No. 55 of 2019, POCSO Case No. 36 of 2019, registered under Sections 376, 504 and 506/34 of the Indian Penal Code and Section 8 of the POCSO Act. The accusation is that Pankaj Kumar (petitioner no.3), son of petitioner nos. 1 and 2, namely, Ramjanam Chauhan and Vimla Devi, developed the physical relation with the daughter of the informant, Rekha Devi, on assurance to perform the marriage. Thereafter, informant requested to petitioner nos. 1 and 2 to perform the marriage of their son, Pankaj Kumar (petitioner no.3) with her

Patna High Court CR. MISC. No.73153 of 2019(2) dt.21-11-2019 2/2 daughter but she was abused and petitioner no. 3 also refused to perform the marriage with her daughter.

Learned counsel for the petitioners submits that after filing the present case, marriage of petitioner no.3 is performed on 21.08.2019 with the daughter of the informant and now both are living together and thereafter, compromise petition has also been filed by the informant and her daughter in the court of S.D.J.M., Sheikhpura on 26.08.2019, which would appear from annexure 3 of the petition.

Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned 1st Additional Sessions Judge, Sheikhpura, in connection with Sheikhpura Mahila P.S. Case No. 55 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
