JUSTICE SANJAY PRIYA ORAL ORDER 3/ 21-02-2018 Heard learned counsel for the petitioner and learned APP for the State as well as counsel for the informant. Petitioner apprehends his arrest in Upahara P.S. Case No.26 of 2017 instituted for the offence under Section(s) 302 and other allied sections of Indian Penal Code and Section 27 of the Arms Act pending in the Court of the Additional Chief Judicial Magistrate, Aurangabad.
In the written report, it is alleged that this petitioner along with Meghnath Singh, Vishnudeo Singh and Manoj Singh, assaulted the brother of the informant with dagger causing serious injuries to him.
Post mortem report has been produced during
Patna High Court Cr.Misc. No.5766 of 2018 (3) dt.21-02-2018 2/2 hearing of the bail petition, which shows that deceased had sustained several sharp cut injuries on his person. Anticipatory bail prayer of one of the accused, Bishnu Dutt Singh @ Bishnu Deo Singh @ Bishun Dutt Singh, with similar allegation has already been rejected by a co-ordinate Bench of this Court by order dated 10.10.2017 passed in Cr. Misc. No.45862 of 2017.
In such circumstances, this Court does not find it a fit case for grant of anticipatory bail.
Prayer of the petitioner for grant of anticipatory bail is rejected.
Petitioner may surrender before the Court below and seek regular bail, which shall be considered and disposed off in accordance with law on its own merit without being prejudiced by this order.
