In this case, the petitioner is seeking regular bail in connection with Bhorey P.S. Case No. 51 of 2020, registered for the offences punishable under Sections 341, 323, 326, 307/34 of the Indian Penal Code and Section 27 of the Arms Act. As per allegation, after closing his jewellery shop, the informant was proceeding to his house. Some miscreants stopped him and started firing on him and made him injured. The learned counsel for the petitioner has submitted that the petitioner is not named in the FIR. His name has figured in confessional statement of co-accused Pintu Kumar. The names of co-accused Ashok Singh and Jamil Alam were also

No.1857 of 2023(2) dt.06-04-2023 2/3 figured in confessional statement of co-accused Pintu Kumar and they have been granted bail the co-ordinate Benches of this Court in Cr. Misc. Nos. 33192 of 2020 and 37110 of 2020 respecitvely. The petitioner is under custody since 27.09.2022. On the other hand, the learned APP has opposed the prayer for bail.

Considering the above-mentioned facts and circumstances as well as period of custody, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Bhorey P.S. Case No. 51 of 2020, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available on each and every date of trial. In case of failure on two consecutive dates without any valid reason, the learned court below will be at liberty to cancel the bail bond of the petitioner.

(ii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

No.1857 of 2023(2) dt.06-04-2023 3/3 (iii) If the petitioner is found involved in future in the similar type of offence, the prosecution will have liberty to file an application before the court below for cancellation of the bail of the petitioner and the learned court below will take decision in accordance with law.
