Petitioner seeks bail in a case registered for the offences punishable under Sections 341, 323, 325, 307, 354(B) of the Indian Penal Code and later on Section 302 of the Indian Penal Code was added.

Allegation against the petitioner is of commission of assault with iron rod to the informant, as a result whereof, the informant died subsequently. The postmortem report would reveal that the Doctor has found only laceration near the left upper arm and no other injury on any vital part of the body.

Considering the fact that the prosecution allegation is not corroborated by medical evidence, let the petitioner, above named, be released on bail on furnishing

Patna High Court Cr.Misc. No.10696 of 2018 (3) dt.09-04-2018 bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with S.Tr.No.282 of 2015 arising out of Hilsa Police Station Case No.163 of 2015, subject to the condition that the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
