JUSTICE SATYAVRAT VERMA ORAL ORDER 04-03-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State through the virtual Court proceedings. The petitioner seeks bail in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 504, 325, 307, 302 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and is in custody since 24.08.2022.

The informant alleges that accused persons including the petitioner came variously armed and Sipahi Rai fired causing death of the wife of the informant and rest of the accused assaulted his sons.

Learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case.

Patna High Court CR. MISC. No.740 of 2023(2) dt.04-03-2023 2/2 Specific allegation of firing is against Sipahi Rai and petitioner is not alleged to be the assailant nor any specific overt act has been alleged against him.

Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.

Considering the submission aforesaid and the fact that petitioner is a person with clean antecedent, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Shahpur P.S. Case No. 225 of 2019.
