JUSTICE BIRENDRA KUMAR ORAL ORDER 30-03-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is languishing in custody for the offence punishable under Section 392 of the Indian Penal Code. The FIR of the occurrence of robbery is against unknown. The petitioner is in custody since 02.11.2017. Submission is that the petitioner was never put on Test Identification Parade. Nothing was recovered from his possession. He has got no criminal antecedent. Investigation is complete now. Only allegation against the petitioner is that his name has surfaced in his self confession before the police during investigation.

Considering the aforesaid submission, let the

Patna High Court Cr.Misc. No.9721 of 2018 (4) dt.30-03-2018 P2/ petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Panjwara P.S. Case No.107 of 2017, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
